The Implications of the SCC Red Chris Decision for EA in Canada

Abstract


The Supreme Court of Canada does not hear environmental cases very often. The 2010 decision involving the Red Chris Mine was the first decision in almost 20 years to consider the federal EA process. As such, it is an important case even if the Act that it was based on has since been fundamentally changed.
